How the calculation works

Rule of thumb as orientation.

German case law does not establish a fixed entitlement to severance. Practice and the established rule of thumb nevertheless provide useful orientation – which can vary considerably in individual cases.

Standard: 0.5 gross monthly salaries per year of service

Established rule of thumb in employment-law practice: at €5,000 gross and 8 years of service, the typical severance lies around €20,000. The rule of thumb is orientation – not a guarantee or entitlement.

Reason for termination & protection under the KSchG

Those covered by the German Protection Against Termination Act (companies with > 10 employees and at least 6 months of service) negotiate from a substantially stronger position. With operational terminations, a settlement is typically more achievable than with conduct-related terminations.

Age & length of service

Being over 50 and having 10+ years of service can modestly increase the negotiation pot – statistically, prospects of re-employment are lower, which employers often offset with a slightly higher severance.

Legal representation as leverage

Filing a termination protection claim within the deadline creates a negotiating situation in which an amicable settlement with severance becomes attractive for both sides. Without legal representation, employees often leave on the table what would have been legally achievable.

From the moment you receive a termination, you have exactly 3 weeks to file a termination protection claim. Miss this deadline and the termination becomes effective – no matter how unfair it was. The negotiation pot then collapses to zero.

What you should know about severance.

Is the calculator binding?
No. It provides a realistic range based on the rule of thumb plus typical negotiation practice. The individual assessment of your case (litigation risk, evidence, employer strategy) happens in a personal conversation.
Do I have to pay tax on the severance?
Yes. Severance payments are taxable income, but they benefit from the German "one-fifth rule" (Fünftelregelung), which noticeably reduces the tax burden. We structure your settlement tax-efficiently together with our in-house tax department.
What does the advisory cost?
If you have legal expenses insurance, most insurers cover the full cost. Without insurance we charge under the German RVG (statutory schedule) or via a success-fee model. The first review is always free of charge and without obligation.
What if the termination is legally valid?
It happens more often than you might think – and it is still no reason to walk away empty-handed. Even with a valid termination, settlement agreements with severance can often be negotiated, because the employer wants to avoid risk and effort.
How quickly does this run?
